Nearly two months ago, a Polk County jury deliberated only 30 minutes before convicting Carlos Carrizales, 61, of raping and impregnating a 13-year-old profoundly disabled girl.
BARTOW — Carlos Carrizales stood silently and nearly motionless Monday as Circuit Judge William Sites sentenced him to life in prison, the maximum sentence he could have received.
Nearly two months ago, a Polk County jury deliberated only 30 minutes before convicting Carrizales, 61, of raping and impregnating a 13-year-old profoundly disabled girl. They had heard testimony during the two-day trial that the girl’s disabilities, including cerebral palsy, would have prevented her from understanding either the attack or her pregnancy. She delivered the child — a daughter — in March 2017. She, too, was born with the same physical and intellectual disabilities as her mother, the victim’s mother said.
The six-member jury also found Carrizales of Frostproof guilty of incest and impregnating a child under 16, both of which are third-degree felonies. Circuit Judge Williams Sites imposed the maximum sentence of five years for each of those convictions.
Carrizales was arrested in November 2017 after DNA testing showed a 99.99% probability that he was the baby’s father. He was released under house arrest after posting $100,000 bail, but was returned to custody March 6 following his conviction.
Law enforcement tested dozens of men who had contact with the girl, including teachers and relatives, before they ran Carrizales’ DNA, according to court testimony.
Bartow lawyer Robin Stevenson, representing Carrizales, argued that the DNA samples had been contaminated. During the trial, Carrizales testified that he couldn’t be the baby’s father because he never had been alone with the victim long enough to have sex with her. He said others were present even when he changed the girl’s diaper.
In her opening statement, Assistant State Attorney Lauren Randall told jurors the state’s case was based in science.
“The evidence that you will see and hear in this case is governed by three things — the laws of nature, the laws of science and your own common sense,” she said.
Two independent laboratories tested Carrizales’ DNA, each reaching the same result, she said.
